Terms of Service

By using SurfSnap.io — whether by creating an account, subscribing via our website, or signing up through a Facebook Lead Ad — you represent that:

• —You are at least 13 years of age.
• —You have the legal capacity to enter into a binding agreement.
• —You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
• —The phone number you provide is yours, and you are authorised to receive messages on it.

SurfSnap.io is a subscription-based surf forecast alert service. Once subscribed, you receive daily automated messages containing surf condition data for your chosen surf spot(s), including:

• —Wave height (minimum and maximum) in feet.
• —Primary swell height, period, and direction.
• —Wind speed and direction.
• —An overall surf rating (e.g. Good / Choppy) based on swell and wind conditions.

Forecast data is sourced from Surfline's publicly available forecast API. SurfSnap.io is an independent service and is not affiliated with, endorsed by, or sponsored by Surfline.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

SurfSnap.io is offered on a subscription basis. The following plans are currently available:

• —Starter Plan — $7/month or $60/year — 1 surf location, 3-day forecast window, WhatsApp & SMS alerts.
• —Pro Plan — $20/month — 3 surf locations, 7-day forecast window, WhatsApp & SMS alerts.
• —Elite Plan — $40/month — 10 surf locations, 14-day forecast window, WhatsApp & SMS alerts.

Paid subscriptions are billed monthly in advance. By providing payment details, you authorise us to charge your payment method on a recurring basis until you cancel. All prices are in US dollars and exclude applicable taxes.

We reserve the right to change our pricing with at least 30 days' notice. If you do not agree to a price change, you may cancel before the new price takes effect.

New subscribers may be eligible for a 7-day free trial on paid plans. During the trial period, you will have full access to the features of the plan you selected. The following conditions apply:

• —A valid payment method is required to start a free trial.
• —You will not be charged during the 7-day trial period.
• —If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
• —Free trials are available once per user. Creating multiple accounts to obtain repeated free trials is not permitted.

You may cancel your subscription at any time from your account settings or by contacting us. When you cancel:

• —Your subscription remains active until the end of the current billing period.
• —You will not be charged for the following billing period.
• —No partial refunds are issued for unused days in the current billing period.
• —If you believe you were charged in error, contact us within 14 days of the charge and we will investigate.

You agree to use SurfSnap.io only for lawful purposes and in accordance with these Terms. You must not:

• —Provide false or misleading information when creating your account.
• —Use our service to harass, harm, or impersonate any person.
• —Attempt to gain unauthorised access to any part of our systems or infrastructure.
• —Use automated scripts or bots to interact with our service.
• —Resell, redistribute, or sublicense access to SurfSnap.io without our prior written consent.
• —Interfere with or disrupt the integrity or performance of our service.

Violation of these terms may result in immediate suspension or termination of your account without refund.

Surf forecasts are provided for informational purposes only. While we strive to deliver accurate and timely data, ocean and weather conditions are inherently unpredictable. We do not guarantee the accuracy, completeness, or timeliness of any forecast information.

SurfSnap.io alerts should not be used as the sole basis for decisions about your safety in the water. Always exercise good judgement, check local conditions on-site, and adhere to any official beach or surf advisories in your area.

All content, trademarks, logos, software, and other intellectual property associated with SurfSnap.io are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable licence to access and use the service for personal, non-commercial purposes only.

You may not copy, reproduce, modify, distribute, or create derivative works from any part of SurfSnap.io without our prior written permission.

SurfSnap.io is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• —Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• —Any warranty that the service will be uninterrupted, error-free, or free of viruses or harmful components.
• —Any warranty regarding the accuracy or reliability of forecast data.

To the maximum extent permitted by applicable law, SurfSnap.io and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or personal injury — arising from your use of, or inability to use, the service.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid us in the 3 months preceding the claim.

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if we determine that continued service would expose us or others to legal or financial risk. We will notify you where reasonably practicable.

You may terminate your account at any time by contacting us. Upon termination, your right to use the service ceases immediately, and we will handle your data in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or your use of SurfSnap.io shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction, as applicable.

We may update these Terms from time to time. When we make material changes, we will notify you via SMS or email (if provided) at least 7 days before the new Terms take effect. We will also update the "Last updated" date at the top of this page.

Your continued use of SurfSnap.io after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must cancel your subscription before the effective date.
